Comey made the disclosure to argue the point that the prosecution of Petraeus, who knew he had top secret information and lied to the FBI about it, differed from the investigation into Hillary Clinton's handling of classified information.

"You did not look at testimony that Hillary Clinton gave", Chaffetz said with evident surprise, "knowing that you got a criminal referral, though you were also looking at whether or not Hillary Clinton had provided false testimony, which is a crime, to Congress?"

The FBI's decision not to recommend charges seemed to have come down to a question of intent, according to Comey.

The State Department has reopened its investigation into the emails, with a mission to determine "how classified emails to and from Clinton's private server were categorized at the time they were sent".

Comey says no one influenced his decision in any way. Did her lawyers read through every single email they reviewed before returning the material to the State Department?

"They may well have been able to establish gross negligence, and that's what the statute calls for", Malcolm said, referring to a provision of the Espionage Act that stipulates it's illegal to disclose classified information through "gross negligence."

Comey: "No, we found work-related emails, thousands, that were not returned". She was not ultimately convicted for the trading, but for making false statements to investigators and obstruction of justice.

A representative for the Clinton campaign was not immediately available for comment. "But if you are Hillary Clinton and you seek a promotion to commander in chief, you will not be", he said.

Let's dispense with the matter of Mrs. Clinton's intent - a side issue that Director Comey magnified into the dispositive issue. "We try very hard to apply the same standard whether you are rich or poor, white or black, old or young, famous or not known at all", he said.

"I hope they know that view, not just my view.my team was honestly held, fairly investigated and held with unusual transparency", Comey added.

Comey explained that he could not prove Clinton knew she would receive classified information on her unsecured server, and beyond that, that she chose to use the system anyway. Others have also been marked classified after the fact. Far more weighty in the exercise of prosecutorial discretion would be two factors Comey did not cite at all in his presentation: (a) Congress's objective in criminalizing the grossly negligent mishandling of classified information, and (b) the harm actually done to the United States which, viewed from the perspective of the intelligence community underwritten by 50 billion American taxpayer dollars annually, was surely enormous.
